So, world leaders, including Brazilian, began to establish increasingly strict policies crvl for waste disposal, they derive from the public initiative originally responsibilities inherent to it, attributing crvl them mainly the private sector, already burdened enough.
This resolution stands out for imposing liability to almost all loved the production chain, crvl such as generators, producers, importers, retailers, re-refiners, recyclers and collectors, committing them from collection to final disposal of waste, mainly because Brazilian Association of Technical Standards (ABNT), through its NRB10004, classifies the used lubricating oil as hazardous waste to present toxicity.
Among the obligations brought by the standard, it emphasizes the requirement that all lubricating oil used in Brazil is, necessarily, recyclable, and should that be used or contaminated for recycling through the re-refining process, a percentage not less than 30 % in the finished lubricating oil and marketed by them.
- When generator (person or entity that generates used lubricating oil, contaminated) fits, among others, collect this waste in suitable containers and resistant to leaks, rather accessible collection; and demand from the point of collection or catcher authorized to issue the certificate collection.
- Already the producer and the importer must, in addition crvl to collecting the waste in the proportion established in standard (non-recyclable including crvl those arising from the use by individuals), give him the environmentally friendly treatment. Another important obligation allocated to producers and importers is to provide IBAMA and when prompted, the state environmental agency, quarterly, monthly information as provided for in Resolution concerning volumes of: a) lubricating oils marketed by type, including those exempted from collection; b) collection hired by collector; c) re-refined base oil purchased for re-refiner.
- In relation to the dealer, or legal person who sells lubricant finished oil wholesale and retail - such as service stations, workshops, supermarkets, auto parts stores, crvl wholesalers, etc. - the facilities to dispose of duty stands crvl out appropriate, licensed by the environmental agency, to replace the used or contaminated oil, disposing this waste to authorized collector upon presentation of permits issued by the competent bodies and their collection certificate. It is also noteworthy that the dealer must disclose to the consumer at the place of sale display of lubricating crvl oil, post-use allocation procedures in the disciplined manner in the resolution.
Remember that, under the standard, all finished lubricants packaging must indicate the use and the form of return of these after used or contaminated, they are recyclable or not.
Finally, all entities must maintain for monitoring purposes, the supporting documents of finished lube oil purchase and the lubricating oil collection certificates used or contaminated, for five years.
